These Terms of Service (“Terms”) constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“Carrier,” “you”), and Wayu Logistics LLC d/b/a Axiom Freight (“Company,” “we,” “us,” or “our”), concerning your access to and use of the goaxiomfreight.com website and our dispatch and yield optimization services.

Axiom Freight provides AI-assisted yield management, route analysis, and independent dispatch coordination for licensed motor carriers and owner-operators. We operate solely as an independent dispatch service representative and do not act as a licensed freight broker or motor carrier.

While Axiom Freight utilizes market data and negotiation strategies to optimize net revenue per mile (RPM), spot market freight rates fluctuate dynamically. Submitting a Fleet Audit or engaging our services does not guarantee specific gross revenue figures, load availability, or lane rates.

Carriers utilizing Axiom Freight services remain fully responsible for:

Maintaining active USDOT/MC operating authority in good standing.
Maintaining valid commercial auto liability, general liability, and cargo insurance policies.
Compliance with all Federal Motor Carrier Safety Administration (FMCSA) regulations, Hours of Service (HOS) rules, and state laws.

5. LIMITATION OF LIABILITY

To the fullest extent permitted by law, the total liability of Wayu Logistics LLC d/b/a Axiom Freight for any claim, dispute, or action arising out of or related to our services shall be limited strictly to the amount paid by the user to the Company for the specific transaction in dispute. Axiom Freight shall not be liable for shipper/broker detention delays, weather cancellations, highway delays, equipment breakdowns, or third-party broker non-payment.

In the event of any controversy or claim arising out of these Terms, the parties shall first attempt in good faith to resolve the dispute through informal negotiations. If unresolved within 30 days, the dispute shall be settled by binding arbitration in Harris County, Texas. Any claim must be brought within one (1) year after the cause of action arises.
